The Consequences of a DUI Charge in Ohio

According to Ohio Revised Code §4511.19, a Dui charge can be filed against an individual discovered to be operating a motor vehicle while impaired by alcohol or drugs. If the driver's BAC is .08 or above, or if there is a certain amount of drugs in their system, they may be facing chemical evidence to support their arrest. These tests do not guarantee a conviction, though, as a lawyer may be able to help get the results invalidated as a result of the test being compromised.

Once arrested for a Dui charge, the alleged offender's driving privileges will automatically be suspended. The accused can request a hearing to temporarily reinstate their ability to drive while the case is being investigated, but they will have to argue their case at a hearing. A lawyer can represent you at this hearing and fight on your behalf to regain your driver's license during the weeks or months it may take to resolve your DUI case.

The potential penalties for a DUI charge vary depending on the offender's criminal background. For a first time offender, they face a minimum of 72 hours in prison that can be extended up to 180 days. In addition, you may be fined up to $1,075. You may also be required to install an interlock ignition device on your vehicle or to attend an alcohol rehabilitation program.

Mayor's Court in Norwood

Unlike most other states, Ohio employees a system called Mayor's Courts. These city-operated courts are designed to alleviate the stress on Municpal Courts by handling most minor offenses such as traffic citations and DUI charges. If your arrest occurred within the city limits of Norwood, your DUI case will most likely be processed at the Mayor's Courts, meaning that you'll need to report there for hearings and court dates.

The Mayor's Court system has been heavily criticized as potentially prejudiced, however. Any funds received by the Court are added to the city's budget, which is controlled by the Mayor, who also presides over the cases heard in Court. This leads to an obvious situation for potential bias. A lawyer on your side can help ensure that your case is handled fairly and without bias as it's processed in the Mayor's Court.
